Why Act Now?

Current experience indicates perhaps more than 10% of Connecticut
underground tanks are leaking. The state, in past legislation, made an additional
$16.5 MILLION available for the
Yank
The Tank program.
Although
no longer available, this program was passed into law to give homeowners the
incentive to act before any more tanks are leaking. It is not expected to
be extended.
The sooner you remove the tank, the less
likely it is to be leaking. Tank testing or insurance products do
not change the only certainty about underground bare steel tanks - they are corroding
and will all someday leak.
There are many details to the aforementioned law and we strongly suggest you:
Keep in mind that the State of Connecticut or any local ordinance does not
require tank removal at this time. It simply is the smart thing to do.
Tank Insurance

Tank insurance is not the answer for two reasons:
- With very few new underground tanks going in the ground, the
population covered by any program gets one year older and is more likely to leak. The
result is the long-term viability of any underground tank insurance program is just not
there. Try to imagine how an insurance company could survive by only selling life
insurance to people over 70 this year and only to people over 71 next year and so on. We
believe many policy holders will find no coverage available on renewal leaving them with
premiums paid and the old tank still in the ground and more likely to be leaking than
before they starting paying tank insurance premiums.
- The restrictions in the fine print of these policies needs
to be clearly understood. There are significant deductibles and some will not provide any
coverage for a "voluntary pull". This means that you are not protected at all if
you remove your tank before you believe it is leaking. They are trying to discourage
removal before the policy period expires to reduce their claims. Obviously the long-term
benefit to an insurance company selling this type of plan would be for the removal before
it leaks and not result in a claim. This appears to be strategy to make some quick dollars
and get out of the business.
For these reasons we have not and do not offer the
underground tank insurance programs. This has been our policy since the H.E.L.P. program
was announced several years ago only to withdraw from the market a few years later. We
simply refuse to offer products to our customers that do not represent value to the
customer. Unfortunately, this has been and we suspect will continue to be the case
with these programs.
Our solution: Yank the Tank!
We have put together a basement (or garage) oil tank
program that includes:
- Transferring the product in the underground tank to your new
aboveground tank;
- Securing the underground tank so it can not be refilled;
- Obtaining the necessary permits for the installation of the new
tank

Above-Ground Tank Replacement

Terms and Conditions:
- Leahys Fuels Inc. will
replace your leaking above-ground 275-gallon oil storage
tank with a new 275-gallon tank, parts and labor
included.
- The leak must be due to
internal corrosion, and not due to external forces, i.e.
puncture, fire damage, abuse.
- The existing 275-gallon oil
tank will be pumped out and removed. Any usable oil will
be transferred to the new oil tank. The accessibility of
the oil tank is the homeowners responsibility.
- There will be no additional
charge for an emergency pump-out, or temporary oil
storage should this be necessary.
- An additional charge may be
added should the tank need to be relocated, new oil lines
installed, or any other conditions beyond our control.
This will be determined before the new tank is installed.
- If the leaking oil storage tank is in a regulated
area of a municipality, and the replacement tank requires secondary containment,
a vertical double-wall 275-gallon oil tank will be provided. The homeowner
will only pay the difference between a regular 275-gallon tank and that of
a vertical double-wall 275-gallon tank. Price is dependent on prevailing rates.
- Leahys Fuels Inc. will
not be responsible for lost product, clean up, or damages
caused by a leaking oil storage tank. It will be the
homeowners responsibility for any charges should an
outside contractor be required to contain or clean up the
leaking oil.
- Leahys Fuels Inc.
reserves the right to inspect the above ground oil
storage tank to make sure it qualifies for this plan.
- On the initial purchase of
the tank replacement plan, coverage will begin 30 days
after payment is received.
- This annual agreement is
self-renewing at prevailing rates upon the
customers acceptance of the renewal invoice.
- This plan may be terminated
by Leahys Fuels, or an additional charge added, if
the customer:
- Fails to keep their account current.
- Fails to purchase a minimum of 300 gallons
of fuel oil.
